Terms of Use
1. Acceptance of Terms
By downloading, installing, or using Kid Memory Capsule — Symptom & Health Tracker ("Kid Memory Capsule", "the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms form a legally binding agreement between you and Dr. Zee, MD, the developer of Kid Memory Capsule ("Developer", "we", "us", or "our").
2. Not a Medical Device — Important Disclaimer
Kid Memory Capsule is designed to help you track and organize personal health information for your own reference. The App, its features, reports, and insights are provided for personal informational purposes only.
- Kid Memory Capsule is not a medical device as defined by the FDA or any regulatory authority
- Reports and insights generated by Kid Memory Capsule are for personal use only and not for clinical diagnosis
- Nothing in the App constitutes medical advice, a clinical diagnosis, or a treatment recommendation
- Always consult a qualified healthcare provider for medical decisions, diagnosis, or treatment
- Do not delay seeking professional medical care based on information viewed in Kid Memory Capsule
- You are solely responsible for your own health decisions
In a medical emergency, call 911 or your local emergency services immediately.
3. Use of the App
You agree to use Kid Memory Capsule only for lawful, personal, non-commercial purposes. You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Use the App to store or process data belonging to third parties without their consent
- Attempt to bypass or circumvent subscription or licensing mechanisms
- Use the App in any way that violates applicable laws or regulations
You must be at least 13 years of age to use Kid Memory Capsule. By using the App, you represent that you meet this requirement.
4. Subscriptions & Billing
Kid Memory Capsule offers the following premium options:
Annual Subscription — $29.99/year
- Billed annually at $29.99 USD (or equivalent local currency)
- Auto-renews each year unless cancelled at least 24 hours before the renewal date
- You may cancel at any time through your App Store or Google Play subscription settings
- Cancelling stops future renewals; you retain access through the end of the current billing period
Lifetime Access — $49.99 (one-time)
- One-time payment of $49.99 USD (or equivalent local currency)
- Grants permanent access to all current premium features
- No recurring charges
Prices may vary by region based on App Store/Google Play pricing tiers. Prices are subject to change; any price changes will be communicated in advance.
All purchases are processed through Apple App Store or Google Play. Your payment information is handled entirely by Apple or Google — the Developer does not access, store, or process payment card details.
5. Free Trial
Kid Memory Capsule offers a 14-day free trial for new subscribers to the annual plan. During the free trial:
- You will not be charged during the 14-day trial period
- You have full access to all premium features
- If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged $29.99
- To avoid charges, cancel at least 24 hours before the trial period ends through your App Store or Google Play account settings
Free trial eligibility is determined by Apple or Google and is generally available only to users who have not previously subscribed to Kid Memory Capsule.
6. Refunds
All purchases made through Kid Memory Capsule are subject to the refund policies of the applicable platform:
- Apple App Store: Refund requests must be submitted to Apple through reportaproblem.apple.com
- Google Play: Refund requests must be submitted to Google through the Google Play Help Center
The Developer does not process refunds directly. All refund decisions are made by Apple or Google in accordance with their policies.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App will be error-free, uninterrupted, or free of harmful components
- Warranties regarding the accuracy, completeness, or reliability of any content, insights, or reports generated by the App
The accuracy of symptom tracking, pattern recognition, and health insights depends entirely on the data you enter. The Developer does not warrant that any insights or reports are accurate, complete, or suitable for any health decision.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:
- Loss of data
- Health outcomes resulting from reliance on App content
- Any unauthorized access to your locally stored data
In no event shall the Developer's total liability to you exceed the amount you paid for the App in the twelve (12) months preceding the claim.
9. Intellectual Property
All intellectual property rights in the App — including but not limited to software code, design, graphics, trademarks, and brand elements — are owned exclusively by Dr. Zee, MD. Nothing in these Terms grants you any right, title, or interest in the App beyond a limited, non-exclusive, non-transferable license to use the App for personal purposes.
Data you enter into Kid Memory Capsule (symptom logs, notes, photos) remains yours. The Developer does not claim ownership over your personal data.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Illinois.
11. Changes to Terms
We reserve the right to update these Terms at any time. When we do, we will update the Effective Date at the top of this page. For material changes, we will provide notice within the App. Continued use of Kid Memory Capsule after updated Terms are posted constitutes your acceptance of the revised Terms.
